Data Protection (GDPR)

DATA PROTECTION

 

1. You acknowledge that, subject to applicable laws, we may, as a data controller (as that term is defined in the Data Protection Legislation):

(a) record, store, use and otherwise process records and information about you and any User whose Personal Data is disclosed to CaSys Technologies, by or on behalf of you, including Personal Data or special categories of Personal Data referred to in Articles 9 and 10 of the Data Protection Legislation); and use and otherwise process information about your accounts, Transactions and Instructions,

(b) To the extent that the GDPR applies, the Data Protection Notice sets out CaSys Technologies' obligations and your and your User's rights regarding such collection and use, and provides the legally required information in this regard, including information regarding the legal basis for the processing, the sources and categories of Personal Data collected, the categories of recipients of the Personal Data and the criteria used to determine the period for which the Personal Data will be retained.

 

2. Before using the Sites or Services, you undertake and guarantee to have brought to the attention of your Users the Data Protection Notice and you acknowledge that CaSys Technologies may process the Personal Data of your Users as set out in these CaSys Platform Terms.

3. Unless legally or contractually required to do so, you and the Users are under no obligation to provide CaSys Technologies with Personal Data. However, access to and use of the Sites and/or Services may be restricted if the customer or Users do not provide Personal Data.

 

4. The Site(s) may use small pieces of text known as cookies that are either used only for the duration of a session and then deleted from a User's hard drive ("Session Cookies"); or that are stored on a User's hard drive and later used to identify that User, or information about that User, the next time the User logs on to the Site(s) ("Persistent Cookies") (together "Cookies"). Session Cookies are used to store unique session tokens to identify the client or user and to obtain limited information about the client's and user's interaction with the Site.

 

Persistent cookies may be used by the Site(s) to store the user's username and preferences (e.g., time zone and language) to improve the login process. None of the persistent cookies that may be used on the Site(s) are essential to its operation. CaSys Technologies may use other technologies to monitor and record a User's and/or Customer's use of the Site(s) or Services. This may include, but is not limited to, monitoring and recording the times of day that a user accesses the Site(s) and the particular pages of the Site(s) that a user navigates. This information may then be used for marketing purposes by CaSys Technologies.

By accepting the Agreement, the Customer and User consents to:

(i) the use of Cookies;

(ii) the monitoring and recording of the use of the Site(s) and/or Services; and

(iii) the use of any data collected for marketing purposes. In addition, before allowing a User to access or use the Site(s) or Services, the Customer agrees to obtain the User’s consent to:

(a) the use of Cookies;

(b) monitoring and recording the use of the Site(s) and/or Services; and

(c) the use of any data collected for marketing purposes. The User may withdraw his/her consent to the use of persistent cookies by choosing to block such cookies in the browser settings of the device(s) used to access the Site(s).

 

The User may withdraw his consent to the use of his Personal Data for marketing purposes by sending a request to CaSys. In the event of withdrawal of consent to Persistent Cookies and/or to the use of Personal Data for marketing purposes, the Client and the User retain the rights to access the Site(s) and the associated Services in accordance with the Agreement. Session Cookies and other controls for non-marketing purposes are essential to the use of the Site(s) and the Client and the User must accept their use to access the Site(s). Without this acceptance, the Client and the User cannot access or use the Site(s) and its associated Services.

5. The Client will fully cooperate with Casys Technologies in requests for information made by any third-party supplier, reseller or regulatory authority.
